Welcome to Pickup Fox. Pickup Fox is operated by RC Group Holdings LLC ("RC Group Holdings LLC," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of PickupFox.com (the "Site") and the services provided through Pickup Fox (the "Services"), including recruiting, contractor onboarding, driver communications, scheduling, work assignments, operational communications, and logistics operations. By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or the Services.

1. Our Services.

Pickup Fox provides local last-mile delivery and logistics services in the Atlanta, Georgia region, including delivery coordination, warehouse integration, route optimization, and driver and contractor workforce operations. Pickup Fox facilitates the transport of goods from designated pickup locations to delivery destinations. We may expand, modify, suspend, or discontinue any Service at any time without prior notice.

2. Eligibility.

You must be at least 18 years old and capable of entering into legally binding contracts to use the Site or the Services. Our Services are currently available only within our designated local service areas in Georgia.

3. Pickups and Deliveries.

You are responsible for ensuring that items are ready for pickup at the scheduled time and for providing accurate pickup and delivery addresses. We reserve the right to refuse items that are hazardous, illegal, or exceed our weight and size limitations. Delivery times provided are estimates only and are not guaranteed.

4. Fees.

Any fees for Services will be communicated and agreed upon before Services are provided. Where payments are processed, RC Group Holdings LLC uses secure third-party payment processors.

5. Driver and Partner Applications.

If you apply to drive for Pickup Fox or to partner with us, you agree to provide accurate and complete information. Submitting an application does not guarantee engagement. Any driver or partner relationship will be governed by a separate agreement.

6. SMS/Text Messaging.

Message Types: If you provide your mobile phone number and consent to receive text messages from Pickup Fox, you may receive recruiting, enrollment, onboarding, scheduling, work assignment, operational notification, and driver support messages, such as application status updates, onboarding instructions, scheduling and work-assignment notifications, operational alerts, and responses to your inquiries.

 

Message Frequency: Message frequency varies.

 

Message and Data Rates: Message and data rates may apply. Contact your wireless provider with questions about your text or data plan.

Opt Out: To opt out of text messages at any time, reply STOP to any message from us. If you previously opted out and wish to receive text messages again, you may opt back in by contacting us or submitting a new opt-in request.

Consent: Your consent to receive text messages is voluntary and is not a condition of any purchase or service. For information about how we handle your mobile information, please see our Privacy Policy below.

7. Acceptable Use.

You agree not to misuse the Site or the Services, including by (a) submitting false or misleading information; (b) using the Services for unlawful purposes or to transport prohibited items; (c) interfering with the operation of the Site; or (d) violating any applicable law.

8. Third-Party Services.

The Site and Services may rely on third-party services (such as payment processors and mapping or logistics software providers) to operate. Your use of those third-party services may be subject to their own terms and policies.

9. Disclaimers; Limitation of Liability.

The Site and the Services are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, RC Group Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Site or the Services. RC Group Holdings LLC's total liability for any claim arising from or relating to the Services shall not exceed the amount paid by you for the specific delivery service giving rise to the claim.

10. Indemnification.

You agree to indemnify and hold harmless RC Group Holdings LLC and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or Services or your violation of these Terms.

11. Governing Law; Disputes.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Atlanta, Georgia, and you consent to the jurisdiction of those courts.

12. Changes to These Terms.

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Site or Services after the changes take effect constitutes your acceptance of the revised Terms.
